Regulations of the BILMAX website

DEFINITIONS

BILMAX Online Store - an online store run by the Seller, available under the Internet domain www.bilmax.eu. Purchase in the online store www.bilmax.eu  also means reading and agreeing to accept the provisions of these regulations and all the rights and obligations of the Customer resulting therefrom.

Seller - BILMAX Ömer Bilgiçli with its registered office in Warsaw 02-495, at ul. Herbu Oksza 29/6, NIP: 5223244457, REGON: 523961157 (hereinafter referred to as "BILMAX").

Customer / Consumer - a natural person with full or limited legal capacity, a legal person or an entity  organizational without legal personality but with legal capacity, carrying out, among others, purchases via the internet domain www.bilmax.eu registering to receive your purchases.

Warehouse - a place where Customers' orders are completed.

BOK - Customer Service Office.

Newsletter - the Seller's service consisting in sending customers, with their express consent, free cyclical information about the Store to the e-mail address provided by the Customer.

Promotions - special conditions of sale, regulated on the terms expressed in separate regulations, regarding the special offer of the Store in force at a specific time, which the Customer can use on the terms set out therein. In the event of discrepancies between the provisions of the relevant Promotion Regulations and the provisions of these Regulations, the provisions of the relevant Promotion Regulations shall prevail.

Price - the amount of gross remuneration (including tax) specified in Polish zlotys or in another currency due to the Seller for the transfer of ownership of the Goods to the Customer in accordance with the Sales Agreement.

§ 1. General information

  1. These regulations define the rules for using the BILMAX Online Store located on the website atwww.bilmax.eu/regulamin and also defines the rules for: placing orders for goods available in the BILMAX Online Store, delivering the ordered goods to the Customer, paying the sales price of the goods by the Customer, submitting and considering complaints and the rules regarding the Customer's right to cancel the order and withdraw from the contract.

  2. The Customer is entitled and at the same time obliged to use the BILMAX Online Store only in accordance with its intended purpose, i.e. in particular - the Customer is obliged to refrain from any actions that could affect the proper functioning of the Online StoreBILMAX – from any interference with the content of the Online StoreBILMAX or its technical elements, including the provision of unlawful content.

  3. Browsing the assortment of the Online StoreBILMAX no registration required.

  4. Placing orders by the Customer for goods in the range of the Online StoreBILMAXcan be done in two ways:

  • without registration, just enter your email address and follow the instructions in the shopping cart

  • by registering via the form in the tabwww.bilmax.eu/account/register

 

§ 2. Registration

  1. Online shopBILMAX enables the Customer to set up a user account. In order to set up an account, it is necessary to: register by completing the registration form in the tab: www.bilmax.eu/account/register, acceptance of the regulations of the Online StoreBILMAX and consent to the processing of personal data to the extent necessary to establish, shape the content, change, terminate, properly implement services provided electronically and to fulfill the Customer's orders, in accordance with the Act of 18 July 2002 on the provision of electronic services (i.e. Journal of 2017, item 1219, as amended) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.

  2. After registering in the Online StoreBILMAX each time you log in via the www.bilmax.eu/account/login tab, use the data provided in the registration form.

  3. The customer is obliged to keep secret: login and password to his account in the Online StoreBILMAX. Within the limits resulting from generally applicable law, responsible for all activities related to the use of the login and password to the account in the Online StoreBILMAX is the Customer, and the password is confidential information for the exclusive knowledge of the Customer. Sharing the login and password with third parties is at the sole responsibility of the Customer, and the Seller shall not bear any consequences in this respect.

  4. In order to remove the Customer's account from the Online StoreBILMAX, please send an e-mail requesting deletion of your account to the following e-mail address: info.bilmax@gmail.com.pl  along with providing the return e-mail address of the Customer deleting the account.

 

§ 3. Placing and processing orders

  1. The customer may place orders 7 days a week and 24 hours a day, except for technical and maintenance breaks.

  2. In order to place an order, the Customer should:

  • select the goods/goods being the subject of the order, and then click on the "Add to cart", "Buy now" button (or equivalent),

  • select the type of shipment/collection,

  • enter the details of the recipient of the order and the exact address to which the goods are to be delivered,

  • if you choose delivery by courier, the Customer should additionally enter the correct contact number to contact the courier,

  • if you want to receive a VAT invoice - enter the data necessary to issue an invoice: full company name, registered office, tax identification number

  • click the "Order and pay" button.

Placing an order by the Customer or making a payment means submitting by BILMAX Ömer Bilgiçli with its registered office in Warsaw, 02-495, ul. Herbu Oksza 29/6, NIP: 5223244457, REGON: 523961157 (hereinafter: "BILMAX"), an offer to conclude a sales contract ( purchase) of the ordered goods. Confirmation of acceptance of the order is a statementBILMAX about accepting the offer. HoweverBILMAX reserves that in the event of the inability to fulfill the Customer's order for random reasons (damage to the product at the packaging stage, detection of deficiencies in the product, lack of the product, etc.), the Store will immediately inform the Customer:

  • reserving the right to withdraw from the Sales Agreement and refund the funds within 14 working days, or

  • its partial implementation, at the same time informing the Customer about it, presenting possible variants to choose from: 

    • expected availability of the article,

    • expected waiting period,

    • replacement product.

In the situation described in paragraph 1, the customer has the right to withdraw from  Agreements and the return of the paid amount, regardless of the variants presented by the Seller.

  1. The Customer may withdraw from the concluded contract within 14 days, the day of its conclusion, the Parties agree that the funds are credited to the Seller's account, while the return of the sale price will take place within 14 days from the date of receipt of the Customer's written withdrawal from the contract, which the Customer undertakes to send to the following address: email: info.bilmax@gmail.com.pl.

  2. The cost of returning the goods is borne by the customer. We do not accept cash-on-delivery returns.

  3. The purchased goods are sent to the address provided by the Customer in the order form within 1 to 3 business days, from the date of crediting the payment to the Seller's account. The additional delivery time by the courier should be taken into account. 

  4. The Seller reserves the right not to process orders with incorrect or incomplete address details, as well as in the event of exhaustion of the stock of goods in the Seller's warehouse.

  5. The Seller is not responsible for failure to deliver the order or delay in the delivery of the ordered goods or the execution of the order, resulting from an incorrect or inaccurate delivery address provided by the Customer.

  6. Shipments are not insured - The seller is not responsible for the loss / destruction / time of the shipment or the products contained therein.

  7. The seller is not responsible for failure to deliver the order or delay in the delivery of the ordered goods or the execution of the order, resulting from reasons attributable to the courier company.

 

§ 4.Ceny

  1. Prices within the Store include all applicable duties and taxes, including VAT and are given in Polish zlotys, with the proviso that they may also be expressed in a different currency.

  2. Prices do not include shipping costs. The costs of shipping the Goods are displayed on the Store's website when placing the Order. The total value of the order includes the Price, shipping costs and, if applicable, costs related to additional paid services selected by the Customer. The Seller may, in a selected period, specify the threshold of the minimum value of the order for which the shipment of the Goods is free.

  3. Promotions in force in the Store cannot be combined, unless otherwise expressly provided for in the regulations of the Promotion.

  4. Goods ordered in the Store are delivered on the territory of the Republic of Poland.

 

§ 5. Peasy

  1. The cost of delivery is covered by the customer. The cost of delivery depends on the method of delivery and payment chosen by the Customer. Payment for the goods may be made by the Customer before the goods are delivered to the Customer:

  • Blik via the Przelewy24 system.

  • By direct transfer using the payment system operated by the Przelewy24 (PayPro SA) gateway.

  • Visa and Mastercad cards using the Przelewy24 system.

2. The payment operator is PayPro SA, with its registered office in Poznań, at ul. Kanclerska 15 (60-327), entered into the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto and Wilda, 8th Commercial Division of the National Court Register.

 

§ 6. Returns and complaints

  1. Before collecting a postal or courier shipment, the customer should check whether the packaging has not been damaged in transport. In this case, the Customer should not accept the shipment and, in the presence of a postal worker or courier, draw up a damage report and immediately contact us by sending an e-mail to   address:info.bilmax@gmail.com.

  2. In the case of delivery of the goods via a Courier, the Buyer is obliged to check the conformity of the goods with the contract in the presence of the Courier; in the event of discrepancies, the Buyer is obliged to draw up a report specifying the discrepancies and, within 7 days from the date of delivery of the goods, send the discrepancy report/complaint together with the goods under complaint to the following address: BILMAX Ömer Bilgiçli, ul.Herbu Oksza 29/6, at his own expense, 02-495 Warsaw.

  3. If the purchased product is inconsistent with the contract, the Customer may submit a complaint by e-mail to the following e-mail address: info.bilmax@gmail.comor by traditional mail to the following address: BILMAX Ömer Bilgiçli, ul.Herbu Oksza 29/6, 02-495 Warsaw.

  4. The complaint should contain a description of the complaint and a document confirming the purchase of the goods under complaint from the Seller (copy of the receipt, invoice, order number, confirmation of the transfer from the bank account, etc.).

  5. The Seller does not accept any COD shipments.

  6. The seller will respond to the customer's complaint within 14 days and will send a notification via e-mail about the method of settlement.

  7. If the complaint is considered in favor of the Customer - the Seller will repair or replace the complained goods with full-fledged goods or, if the replacement is not possible, return the amount due for the complained goods within 14 days from the date of considering the complaint.

  8. A customer who purchases goods for purposes related to his professional or business activity (a customer who is not a consumer) has the right to file a complaint in accordance with applicable law, while the Seller's liability under the warranty for physical defects of goods is limited to the amount paid by the customer to the seller for the purchase of the goods.

  9. After a positive consideration of the complaint, the Store returns full-fledged goods at its own expense to the address provided by the Customer.

  10. The Seller reserves the right to refuse to accept a complaint in the following cases: the sole fault of the user, mechanical damage, improper use of the product inconsistent with the instructions on the Store's website.

 

§ 7. Withdrawal from the contract

  1. According to Art. 27 of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827) The consumer has the right to withdraw from the Agreement without giving any reason within 14 days and without incurring any costs other than those provided for by law. Regardless of the withdrawal period indicated in the previous sentence, the Seller may, in the period of his choice, specify a longer period for the Customer to withdraw from the Agreement in the Promotion regulations.

  2. The right to withdraw from the Agreement is not entitled to the Consumer in the cases specified in art. 38 of the Act of 30 May 2014 on consumer rights, in particular when the subject of the service is an item created according to the Customer's specifications or serving to satisfy his individual needs (e.g. Goods with an engraving ordered by the Customer).

  3. In order to withdraw from the Agreement, the Consumer submits a written statement of withdrawal from the Agreement to the Seller. For this purpose, the Consumer may use the form available on the Store's website, which is an attachment to the Regulations. Withdrawal from the contract The consumer may:

  • send by traditional mail to the following address: BILMAX Ömer Bilgiçli, ul.Herbu Oksza 29/6, 02-495 Warsaw, or

  • inform the Seller about the will to withdraw by sending a message to the e-mail address: info.bilmax@gmail.com.

  1. The deadline to withdraw from the Agreement begins on the day on which the Consumer or a third party indicated by him, other than the carrier, came into actual possession of the Goods, which will be confirmed by the signature on the receipt of receipt of the Goods at the agreed address. In the case of an Order covering many Goods delivered separately, in batches or in parts - this period is counted from taking possession of the last of the Goods, the last batch or part.

  2. To meet the deadline to withdraw from the Agreement, it is enough to send a statement before its expiry.

  3. In the event of withdrawal from the Agreement, BILMAX returns to the Consumer the cost of the purchased product/products no later than within 14 days from the date of receipt of the statement of withdrawal from the Agreement from the Client.

  4. If the Consumer has chosen a method of delivering the Goods other than the cheapest usual method of delivery offered by the Seller, the Seller is not obliged to reimburse the Consumer for the additional costs incurred by him.

  5. BILMAX will refund the payment using the same payment method as used by the Consumer, unless the Consumer expressly agreed to a different method of payment refund - in each case, the Consumer will not incur any fees in connection with this refund.

  6. BILMAX may withhold the reimbursement until receipt of the Goods or proof of sending back the Goods, whichever occurs first.

  7. The consumer should return the BILMAX Goods immediately, not later than within 14 days from the date of withdrawal from the Agreement.

  8. The consumer is liable for a decrease in the value of the returned Goods as a result of using them in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the Goods. BILMAX reserves the right to claim damages against the Consumer, to the extent permitted by applicable law.

  9. The Customer bears only the direct costs of returning the Goods to BILMAX. BILMAX may, as part of a promotional campaign or a special offer on the terms set out in separate regulations, offer the Consumer to collect the returned Goods by the Seller from the Consumer.

  10. The return of Goods purchased under the Promotion, in which the purchase of more than one Good was the condition for granting the discount, means withdrawal from the Promotion and is possible only on the condition of returning all Goods, the total purchase of which entitled to participate in the Promotion. In the event that one of the Goods purchased under the Promotion described above is a Good that is not returnable in accordance with art. 38 of the Act on consumer rights (e.g. Goods with an engraving ordered by the Customer), the return of the Goods covered by the Promotion is not possible.

  11. Returned Goods should be sent to the following address: BILMAX Ömer Bilgiçli, ul.Herbu Oksza 29/6, 02-495 Warsaw. Please attach proof of purchase of the Goods, if possible, and the date of return of the Goods is the day on which the Goods arrived at the address indicated above (it may take up to 14 days).

  12. Due to the changes  from 01/01/2021 regarding the confirmation of corrective invoices, the Customer, by joining the Store, confirms and agrees to their issuance.

 

§ 8. Customer Service

  1. The Seller runs a Customer Service Office (BOK), with which the Customer can contact electronically in order to obtain information about the Store or the status of the Order.

  2. The customer may contact BOK on working days (from Monday to Friday, excluding public holidays) from 8:00 to 18:00 by sending a message to the following e-mail address:info.bilmax@gmail.com or via the contact form tab on the Seller's website.

  3. The Seller is not an Internet service provider or a provider of other publicly available telecommunications services within the meaning of the Telecommunications Law. The Customer should, on his own, gain access to a computer station or terminal device by means of which it is possible to place an Order or use the Seller's services, including establishing a connection with BOK.

 

§ 9.

Basic assumptions of the personal data protection policy

  1. The Seller undertakes to protect personal data in accordance with the Personal Data Protection Act of May 10, 2018 (Journal of Laws of 2018, item 1000), the Act on the provision of electronic services of July 18, 2002 (Journal of Laws of 2002, No. 144, item 1204) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC according to which the Customer, by completing the form and providing his personal data to the Seller, consents to their processing by the Seller in accordance with the stated purpose of processing.

  2. The Seller protects Customers' personal data in accordance with the following assumptions:

  • The customer voluntarily consents to the processing by BILMAX of personal data provided by him in the process of registering an account in the Online Store. Lack of consent to the processing of personal data by the Seller will prevent BILMAX from providing services electronically and making purchases by the Customer in the BILMAX Online Store,

  • personal data is used for the purposes for which the Customer has consented,

  • taking into account the nature, scope, context and purposes of processing as well as the risk of violating the rights or freedoms of natural persons with different probabilities and severity of the threat, the Seller has implemented appropriate technical and organizational measures to ensure that the processing takes place in accordance with the above-mentioned provisions. by law. These measures are reviewed and updated as necessary in accordance with applicable legal requirements,

  • at any time, the customer who has given consent has the right to inspect, correct or supplement his personal data, he can also withdraw it by sending an e-mail to the following address:info.bilmax@gmail.com,

  • The Seller may disclose personal data when it is absolutely required by applicable law, in connection with court proceedings, including law enforcement authorities.

  1. The above rules apply only to personal data sent via the form used for this purpose, available on the subpages of the BILMAX Online Store atwww.bilmax.eu.

  2. If you follow a link to another website on the website, you are leaving the BILMAX website, in which case BILMAX is not responsible for the personal data protection practices applied within those websites and is not responsible for external websites or personal data transmitted through them .

  3. BILMAX processes personal data in order to provide services electronically, conclude and perform sales contracts for goods ordered by the Customer in the BILMAX Online Store, and in the event of the Customer's consent, also for marketing purposes, including in particular to send commercial information to the Customer by electronic mail. electronic.

  4. The customer declares that the personal data provided by him are real customer data.

  5. Detailed provisions regarding the protection of the Customer's personal data can be found on the website of the BILMAX Online Store, in the tab dedicated to privacy policy.

Purposes of collecting personal data

BILMAX   collects the personal data of website customers in order to:

  • performance of concluded contracts,

  • marketing, advertising and commercial activities,

  • improving the quality of services provided and their adaptation to the needs of customers,

  • supporting and facilitating contacts with clients.

 

§ 10. ChangesStatuteat

  1. The Seller reserves the right to change the content of the Regulations, in particular due to changes resulting from the law or the practice of applying the law:

  • changes in payment methods,

  • changes in the methods of delivering goods,

  • organizational and legal changes that may occur at the Seller.

  1. Customers will be informed about changes to the Regulations by posting this information on the website www.bilmax.eu/statute.

  2. Any changes to the Regulations apply to customers within 1 month from the date of their publication on the websitewww.bilmax.eu/ /statute.

  3. The current version of the regulations is always available to the Customer on the websitewww.bilmax.eu/ /statute. During the execution of the order and throughout the period of after-sales care, the Customer is bound by the regulations accepted when placing the order.

 

§ 11. Newsletter

  1. Subscribing to the Newsletter is voluntary and free of charge.

  2. In order to receive the Newsletter, the Customer agrees to receive the Newsletter by providing his active e-mail address in a dedicated field or by subscribing through the "Subscribe" tab as part of his Account.

  3. In addition to the e-mail address, when subscribing to the Newsletter, the Customer may provide their date of birth in the dedicated field (if such an option exists), which allows the Seller to send the Customer personalized birthday information, which may include birthday special offers or promotions .

  4. The customer may at any time unsubscribe from receiving the Newsletter by e-mail contact with BOK by sending a message to the address info.bilmax@gmail.com with relevant information.

 

§ 12. Technical requirements and reservations

  1. The Seller provides the Customer with the correct operation of the online store in Google Chrome and Mozilla Firefox browsers in the latest available versions, on screens with a horizontal resolution above 360 px.

  2. The Seller, to the fullest extent permitted by law, shall not be liable for disruptions, including interruptions, in the functioning of the BILMAX Online Store caused by force majeure, unauthorized actions of third parties or for incompatibility of the BILMAX Online Store with the technical infrastructure or the Customer's end device.

 

§ 13. Posfinal prices

  1. These Regulations come into force on the day of its publication on the website on November 25, 2021.

  2. The Sales Agreement and the Agreement for the Provision of Services are concluded in Polish.

  3. The prices of the goods offered by the Seller are expressed in the Polish currency and are gross prices (including VAT), unless they are marked as net prices.

  4. As a standard, products are shipped in individual boxes with the BILMAX logo, however, we reserve the right to ship the goods in boxes without the BILMAX logo.

  5. Products available in the Store should be used in a manner consistent with the information posted on the Store's website entitled How to care for your jewelry.

  6. The Seller may modify the technical manner of providing the Service, in particular for reasons of a technological nature (development of browsers and technologies), but without impairing its quality and without affecting the scope of rights and obligations of the Customer and the Seller.

  7. The Seller provides technical and organizational measures appropriate to the degree of threat to the security of the services provided under the Service Provision Agreement.

  8. Customers may access these Regulations at any time and download them from the www.bilmax.eu/statute

  9. Consolidation, security, disclosure and confirmation to the Customer of the essential provisions of the Agreement for the sale of Goods takes place by sending the Customer a message to the e-mail address provided.

  10. The offer presented by the Seller does not constitute an offer within the meaning of the Civil Code, it is only an invitation to start negotiations (pursuant to Article 71 of the Civil Code).

  11. None of the provisions of these regulations are intended to infringe the rights of the Customer. It also cannot be interpreted in this way, because in the event of non-compliance of any part of the regulations with applicable law. The Seller declares absolute submission to and application of this right in place of the challenged provision of the regulations.

  12. The law applicable to the conclusion of the Agreement is the law of the Republic of Poland, and the courts are common courts in the Republic of Poland, unless otherwise provided by the mandatory provisions of law. Any disputes between the Seller and the Customer who is not a Consumer will be submitted to the court competent for the seat of the Seller,

  13. In matters not covered by these regulations, the relevant applicable legal provisions shall apply. Disputes are resolved by the court competent for the Seller's place and subject matter.
